📝 QATRE DRESS – INTERNATIONAL DISTANCE SALES AGREEMENT

Buyer:
The natural or legal person who places an order through the website and whose name, surname, delivery address, billing address and contact details are specified in the order form.

2. SUBJECT OF THE AGREEMENT

This Agreement regulates the terms governing the sale, payment, international shipment, delivery and return of products electronically ordered by the Buyer through the Seller’s website at www.qatredress.com, as well as the respective rights and obligations of the parties.

For consumers residing in Türkiye, Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation shall apply. Any mandatory consumer rights applicable in the Buyer’s country of residence remain unaffected.

3. PRODUCT AND ORDER INFORMATION

The type, model, color, size, quantity, sales price, currency, shipping fee and payment details of the products are displayed on the product page, cart page and order summary.

Once the order has been completed, the order details will be sent to the email address provided by the Buyer. The invoice may be issued electronically or physically in accordance with applicable legislation.

4. PRICING AND CURRENCY

  • Product prices are displayed in the currency selected on the website or used during checkout.

  • The total order amount is clearly displayed to the Buyer before payment is completed.

  • The Seller is not responsible for exchange-rate differences, foreign transaction fees or bank commissions charged by the Buyer’s bank or payment provider.

  • Refunds will, where possible, be processed using the original payment method and currency. Exchange-rate differences and transaction fees charged by banks or payment providers will not be covered by the Seller.

5. INTERNATIONAL SHIPPING AND DELIVERY

  • Orders are normally prepared and handed over to the shipping carrier within 1–3 business days after payment approval.

  • Shipping fees may vary depending on the destination country and region, product weight and volume, number of items in the order and selected shipping service.

  • The applicable shipping fee will be displayed to the Buyer at checkout before the order is completed.

  • Delivery times may vary depending on the destination country and region, shipping carrier, selected standard or express shipping service and customs procedures.

  • Delivery times displayed at checkout or in order notifications are estimates and may be extended due to customs inspections, public holidays, natural disasters, carrier-related operational issues or other circumstances beyond the Seller’s reasonable control.

  • The Buyer is responsible for providing complete and accurate delivery information. Additional expenses resulting from an incorrect or incomplete address, incorrect phone number or inability to reach the Buyer may be charged to the Buyer to the extent permitted by mandatory legislation.

  • The Seller is responsible, under applicable legislation, for loss or damage occurring until the product is delivered to the Buyer or a person designated by the Buyer.

6. CUSTOMS DUTIES AND ADDITIONAL CHARGES

  • International orders may be subject to customs duties, import taxes, local VAT, customs clearance fees or carrier handling fees, depending on the laws of the destination country.

  • Unless checkout explicitly states that “duties and taxes are included,” such charges are not included in the product price or shipping fee.

  • These charges are determined and collected by the customs authorities, public authorities or shipping carrier in the destination country.

  • The Buyer is responsible for checking the customs and import requirements applicable in their country before placing an order.

  • If a shipment is returned to the Seller because customs duties were not paid, the order was refused or the Buyer failed to complete the required customs procedures, shipping, return and customs-related expenses may be deducted from the refund to the extent permitted by applicable mandatory legislation.

7. PAYMENT

  • The Buyer may pay using a credit card, debit card or any other payment method available at checkout.

  • The order will be processed after payment has been approved by the Seller or the relevant payment provider.

  • The Seller may restrict certain payment methods or offer different payment options in specific countries or regions.

8. RIGHT OF WITHDRAWAL AND RETURNS

  • Unless a longer period is required by applicable mandatory legislation, the Buyer may exercise the right of withdrawal without providing a reason within 14 days from the date the product is received.

  • The withdrawal request must be sent in writing to qatredress@gmail.com before the withdrawal period expires and must include the order number and the Buyer’s contact details.

  • Following the withdrawal notice, the Buyer must send the product to the provided return address in accordance with the return instructions within a maximum of 14 days.

  • The product may only be inspected to the extent necessary to determine its nature, size and basic characteristics. Any loss in value caused by wearing, washing, damaging, staining or exposing the product to odors may be charged to the Buyer to the extent permitted by applicable legislation.

  • The product must be returned complete with its accessories, packaging, invoice and any promotional gifts included in the order.

  • The Buyer must contact the Seller before sending an international return and must follow the return method provided by the Seller.

  • Responsibility for international return shipping costs will be determined according to the mandatory consumer legislation applicable in the Buyer’s country and the return conditions disclosed before purchase.

  • If an incorrect, defective or damaged product is delivered, the Buyer must contact the Seller within a reasonable period after delivery and, where possible, provide photographs of the product. Where the issue is caused by the Seller, an appropriate remedy will be provided in accordance with applicable legislation.

9. REFUNDS

  • After the returned product has been handed over to the shipping carrier or received by the Seller, it will be inspected.

  • For products that comply with the return conditions, the refund will be processed through the payment method used for the order within the statutory period specified under applicable legislation.

  • The time required for the refund to appear in the Buyer’s bank or credit card account may vary depending on the processing times of the relevant bank or payment provider.

  • Import duties, taxes or additional fees paid directly to customs authorities, tax authorities or shipping carriers cannot be refunded by the Seller because they were not collected by the Seller. Where applicable, the Buyer must contact the relevant authority to request a refund.

10. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

  • Products prepared according to the Buyer’s specific requests or personal measurements

  • Products manufactured, altered or personalized specifically for the Buyer

  • Products whose protective packaging or hygiene seal has been opened and which are not suitable for return due to health or hygiene reasons

  • Other products classified as exceptions to the right of withdrawal under applicable legislation

If the Buyer’s country provides more extensive mandatory consumer rights, those rights will remain unaffected.

11. UNDELIVERED AND RETURNED ORDERS

  • Orders returned to the Seller because the Buyer was unavailable at the address, refused delivery, provided incorrect address information or failed to complete the required customs procedures will be inspected upon return.

  • If the Buyer requests reshipment, a new shipping fee and any applicable additional charges may be collected from the Buyer.

  • If a refund is requested, shipping, return and customs expenses not caused by the Seller may be deducted from the refund to the extent permitted by mandatory legislation.

12. GENERAL PROVISIONS

  • Products offered for sale on the website are subject to availability.

  • If supplying or delivering the ordered product becomes impossible, the Buyer will be informed and all collected payments will be refunded in accordance with applicable legislation.

  • Product colors may vary slightly due to screen settings, lighting conditions and photography.

  • The Seller reserves the right to cancel an order if shipment cannot be completed due to import restrictions in the Buyer’s country. In such cases, the collected order amount will be refunded.

13. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement is governed by the laws of Türkiye. However, this provision does not remove or restrict any rights arising from the mandatory consumer protection laws applicable in the Buyer’s country of residence.

The parties should first attempt to resolve any dispute by contacting the Seller. If no resolution can be reached, an application may be made to the competent consumer authorities, arbitration bodies or courts in accordance with applicable legislation.

14. ENTRY INTO FORCE

By completing the order, the Buyer declares that they have read and accepted this Agreement and the Pre-Contract Information Form electronically. This Agreement enters into force on the date the order is electronically confirmed.

The type, model, color, size, quantity, material and other main characteristics of the purchased product are displayed on the product detail page and cart page.

3. PRODUCT PRICE AND PAYMENT INFORMATION

  • The product price, currency, shipping fee and total order amount are displayed in the order summary before payment is completed.

  • Shipping fees may vary according to the destination country and region, product weight and volume and selected shipping service.

  • Exchange-rate differences, foreign transaction fees and bank commissions that may be charged by the Buyer’s bank are not included in the order total.

4. CUSTOMS AND IMPORT CHARGES

International orders may be subject to customs duties, import taxes, local VAT and carrier handling fees depending on the destination country. Unless explicitly stated as included at checkout, these charges may be collected from the Buyer by the relevant authorities or shipping carrier in the destination country.

7. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

  • Products manufactured or altered specifically for the Buyer

  • Products prepared according to the Buyer’s personal measurements

  • Products whose protective packaging has been opened and which cannot be returned for health or hygiene reasons

  • Other products excluded from the right of withdrawal under applicable legislation

8. COMPLAINTS AND OBJECTIONS

The Buyer may send requests or complaints regarding orders and products to qatredress@gmail.com. Any rights arising from the mandatory consumer protection laws applicable in the Buyer’s country remain unaffected.

9. CONFIRMATION OF INFORMATION

The Buyer confirms that, before placing the order, they were informed about the product characteristics, total price, currency, shipping fee, estimated delivery time, possible customs and import charges and the applicable withdrawal and return conditions.
